The Winelands Trails North

1. Membership runs for 13 months form 1 December – 31 December (of the next year) providing acceptance and payment. If you sign up during this term. Half Year Runs from 1 July – 31 December

2. Please allow for 14 days before receiving Membership Board/band. You may use proof of payment (on your phone is fine) as proof of activation until such time as you receive your official board or band.

3. This Membership allows for unlimited usage of the above-mentioned trails, but please be aware of strict usage hours and conditions which may vary at each trail/venue/park). Each trail/venue/park reserves the right to close the trails for any reasons at their own discretion.

4. Usage hours to be noted and strictly adhered to per trail/venue/park: SUNRISE TO SUNSET, unless otherwise specified. | https://paarltrails.com | North Region

5. Trail usage outside these hours is strictly prohibited. We have worked hard to get the landowners’ permission for land usage and have agreed to the above usage hours. Please respect these hours and the landowners’ privacy, if not we could lose the right to use their property.

6. All Trails/Parks remain independent from each other and have their own rules and conditions. Please ensure that you are familiar with each Trail/Park’s terms and conditions, as well as indemnity before any usage.

7. If you have a non-member joining you on the trails, they need to register and purchase a day pass at that specific Trail/Park, Snapscan.

NO EXCEPTIONS – NO PAY, NO USE. This needs to be done BEFORE they use the trail.

9. By purchasing this membership, you understand that it is compulsory to ensure you have Whatsapp and save the Paarl trails and Winelands Trails BOT numbers . once saved open Whatsapp and send one of these numbers a message to open a host of info and safety features . NB again it is compulsory to have this access on your person when using the trails Paarl Trails BOT Number : 071 157 5976 Winelands Trails BOT Number : 076 694 2694 download the TRAILFORKS Phones Apps and make use of it when you use trails. This is for your own safety.

10. It is compulsory to ensure your bike board is always attached and clearly visible on the front handlebars of your bike. If you are running or hiking, ensure you always have your membership band on you.

11. Failure to comply with the above could result in immediate cancelation of membership (non-refundable). We also have arrangements with various event organisers and will blacklist any perpetrators.

12. Included in your membership purchase is a bike board (for MTB) OR member band (for running/walking). If you require both, an extra charge of R150.00 will apply for the additional band/board purchase.

COMPULSORY GEAR REQUIRED FOR ACTIVITIES:

• Mountain biking – Winelands Trails Bike Board

• Running /Obstacle Training/Walking /Hiking – Membership band

• It is vital and advised when using the trails that you have your phone with you and have enough refreshments. We do not advise riding/running alone as there are many technical sections on the trails, and safety is key.

• Helmet, glasses and sunscreen.

GENERAL TERMS AND CONDITIONS

1. These terms and conditions are subject to change at any time .

2. Winelands trail Partners reserve the right to withdraw any product or trail at any without notice and do not have to refund any fees

3. When the above upfront balance reaches zero, the membership will be cancelled, unless renewed explicitly by the member.

4. All notices and processes may be validly served to the member’s residential address, which is hereby selected as the member’s domicilium citandi et executandi. This address is as stated in the Membership Agreement.

5. In the event of one or more of these terms, conditions, rules and regulations being unenforceable they will be regarded as removed – the remaining clauses are still deemed valid.

6. Winelands Trail Partners and associates are hereby authorised to store the member’s personal information and market related products to them via email, phone, Whatsapp and social media. Members may unsubscribe should they wish not to receive any further marketing related communication. By signing this document you also agree to receiving communication from Wine lands Trails and Partners

7. Winelands Trail Partners also reserve the right to send the member operational messaging by whatever channel is deemed appropriate. Operational messaging relates specifically to feature/functionality of your membership, Newsletters and Park Info.

8. Winelands trail Partners reserve the right to contact the member with marketing related offers from time to time. The member may elect to unsubscribe from these communications at any point

9. All members with unpaid accounts will be suspended from all member privileges. These will be reinstated once all arrears have been settled.

10. I and/or my estate hereby indemnify The Companies/ landowners / representatives against any claim by myself or any person arising directly or indirectly from my death, injury, loss, or damage suffered by me or any person as a result of my use of the facilities or services, whether it be allegedly caused or contributed to by an act or omission by The Companies, its directors, employees, contractors, consultants and agents.

FEES, SUSPENSIONS AND RESIGNATIONS

1. Membership is for a period of 12 months, where after it must be renewed.( 1 December – 31 December following year)

2. All Benefits associated to the Winelands Trails shall be suspended whilst the main membership is suspended.

3. A joining fee will be applicable where the member has cancelled and later re-joins.

4. A member will be subject to an annual increase in membership fees of the Membership Agreement, irrespective of any suspensions having taken place on the Membership Agreement. Winelands Trails reserves the right to implement discretionary fee changes at any time.

5. Different suspension fees apply to the different main products from which the member is being suspended.

MEMBERSHIP AGREEMENT TERMS & CONDITIONS (RIDING / RUNNING / WALKING FACILITIES)

I will be entitled to utilise and access the Winelands Trail Partner trails and parks and Partner facilities of the Company in accordance with my Membership Type from the start date, subject to the payment of the appropriate membership fees and signature of this agreement.

The Company may at any time withdraw all or part of its facilities for any period in connection with the repair, alteration, loss or refurbishment of the facilities or for any reasons beyond the control of the partners.

1. In the event that my bank details and/or personal details change, I undertake to update the information by means of the ‘Change of Details’ form, which can be found at email [email protected].

2. The Companies / partners reserve the right to cancel this agreement should I breach any of the terms and conditions of this agreement including the Rules and Regulations that are in force currently. I confirm that I have familiarised myself with the Rules and Regulations of The Companies / partners / parks / trails and venues.

3. If the facility ceases to operate, for whatever reason and access is no longer possible, then my membership could be terminated, and I shall have no claim against the Companies.

4. No rogue usage is allowed. Any person making use of the trails must be a member or registered and paid for the usage, if found not doing this Winelands trail Partners have the right to immediately suspend the person/member or person using the facilities with the member

1. I agree to abide by the individual Code of Conduct, Rules & Regulations of Winelands trails, venues and Partners to which I am affiliated (as specified above).

3. I agree to always carry a mobile phone with me and have emergency contact details of each park on my phone. Indemnity for all Winelands trails and Partners and once signed covers every visit at all parks for as long as person is a member.

I/ We Acknowledge and give my full consent that this Full Indemnity applies once entering a Winelands Trail/park /venue associate.

I/We give full consent to the below conditions for as long as I visit any Winelands Trail parks/venues/Trails and I acknowledge and accept that by entering this premises, I agree that I will not have to sign another indemnity again for these venues and accept the conditions below and at the venue unconditionally and for every time I visit the premises.

I/We hereby acknowledge that:

I/we enter the premises of Winelands trail partner entirely at my/our own risk.

I/We acknowledge that I/we are well acquainted and fully aware of, and accept the real dangers and risks that are associated with visiting/using the facilities; Reserve, Lake, Dam, Pool, Mountain biking, Running, Hiking, Obstacle Trails and all other features at the facilities or on the trails arising from activities/presence of wild and dangerous animals/reptiles, birds, insects and the risk of suffering bodily harm, injury, death, I fully indemnify the Winelands Trail partners/parks/venues and all associated parties from any Theft and or loss to property which may arise as a result of the activities and or presence at any Winelands Trail partner parks/venues.

I/We are fully aware that there are no lifesaving or medical facilities of any nature provided.

I/We hereby acknowledge that I/we are aware of the risks involved in swimming, fishing, canoeing, boating, mountain biking, running, walking, Obstacle, trail usage and all other activities which are or may be offered at Winelands partner parks/trails and all associated trails and accept such risks.

I/ We hereby confirm and acknowledge that I/we are fully capable, fit and knowledgeable and experienced to use, take part, compete in the necessary activities, and features at Winelands Partner Parks/trails.

I/We hereby waive all claim or claims of whatsoever cause or nature weather being of a negligent nature or not, or loss howsoever arising against the owners of any Winelands partner trails/parks, their associates, employees or any person or company connected whether directly, or indirectly with the running of the Venue, and fellow guests/invitees which

I/we might have arising out of harm, injury, death or loss suffered whilst on the premises, and weather arising from an act of commission or omission on the part of those hereby indemnified or any one of them.

I/We therefore indemnify and hold harmless and free the owners of Winelands Partner Trails/parks, their associates, employees and or any person connected whether directly or indirectly with the running of activities and fellow guests/invitees from any and all claims of whatsoever cause or nature which may arise on behalf of my spouse/common law wife/husband, children, whether minor or adult or relative and or persons accompanying me to the park/trail/venue and whether arising from an act of commission or omission on the party of those hereby indemnifies or anyone of them. No helmet, no ride.

Runners/walkers/hikers/obstacle training must have member bands on them. All children under the age of 16 years old must be accompanied by an adult on the trails. It is also your responsibility to store the relevant emergency number of each venue or trail and ensure you can contact the office or emergency number.
